Welcome to SpeakShqip! These Terms of Service ("Terms") govern your use of the SpeakShqip mobile application and website (collectively, the "Service") operated by SpeakShqip LLC ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

2. Description of Service

SpeakShqip is a language learning platform that provides interactive lessons, exercises, and tools to help users learn Albanian. Our Service includes:

  • Interactive language lessons across CEFR levels (A1-C2)
  • Vocabulary flashcards with spaced repetition
  • Reading comprehension exercises
  • Progress tracking and gamification features (XP, streaks, achievements)
  • Audio pronunciations

3. Account Registration

3.1 Account Creation

To access certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old to use our Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. Subscriptions and Payments

4.1 Free Trial

We offer free access to select lessons (A1 Unit 1) with no time limit. This allows you to experience our learning method before subscribing.

4.2 Paid Subscriptions

Premium features require a paid subscription. We offer:

  • Monthly Subscription: $14.99 per month
  • Yearly Subscription: $99.99 per year (equivalent to $8.33/month)

4.3 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew unless you cancel it before the end of the current billing period.

4.4 Cancellation

You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until then.

4.5 Refunds

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with our Service within the first 30 days of your initial subscription, contact us at info@speakshqip.com for a full refund. After 30 days, refunds are handled according to the policies of Apple App Store or Google Play Store.

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Copy, modify, or distribute our content without permission
  • Use automated systems or bots to access the Service
  • Share your account credentials with others
  • Impersonate any person or entity
  • Harass, abuse, or harm other users

6. Intellectual Property

6.1 Our Content

The Service and its original content (including but not limited to lessons, audio recordings, images, graphics, and software) are owned by SpeakShqip LLC and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes, subject to these Terms.

6.3 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our Service without our prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We do not guarantee any specific learning outcomes from using our Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKSHQIP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless SpeakShqip LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

10. Modifications to Service and Terms

10.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10.2 Terms Changes

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpeakShqip LLC regarding the Service and supersede all prior agreements and understandings.
